Terms of Service

1. Acceptance of Terms

By accessing or using Komplex ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to create an account. Users under 18 must have a parent or guardian create and manage their account. Parents and guardians are responsible for all activity under accounts they create for minors, in compliance with COPPA.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must not share your account with others. You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized access.

4. Digital Wallet

  • Wallet balances are stored as integer cents and are non-transferable between users.
  • Wallet funds are loaded via credit or debit card through Stripe. Funds are credited to your wallet after payment confirmation.
  • Wallet balances are facility-agnostic and can be used at any participating Komplex facility.
  • Refunds for cancelled orders are automatically returned to your wallet balance.
  • We reserve the right to limit individual load amounts to $500 per transaction.
  • Wallet balances do not earn interest and have no expiration date.

5. Concession Orders

When you place an order, you agree to pay the listed price plus a $0.99 convenience fee. Orders paid via wallet are debited immediately. Orders paid via card are charged through Stripe. Once an order is confirmed, it may only be cancelled before preparation begins. Refunds for cancelled orders are returned to your wallet.

6. Loyalty Program

Komplex offers a loyalty program that awards points for check-ins and purchases. Points accumulate toward tier upgrades (Rookie, All-Star, MVP, Hall of Fame). Rewards may be redeemed from the rewards catalog when available. We reserve the right to modify point values, tier thresholds, and available rewards at any time.

7. NFC Check-In

Check-in via NFC or QR code is subject to a cooldown period to prevent abuse. We use location verification (geofencing) to confirm you are at the facility. Attempting to manipulate check-in data or circumvent cooldown periods may result in account suspension.

8. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Create multiple accounts to abuse loyalty rewards or promotions
  • Manipulate NFC check-in data or attempt to spoof location
  • Reverse-engineer, decompile, or disassemble the Service

9. Intellectual Property

The Komplex name, logo, and all associated content, features, and functionality are owned by Komplex and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

10. Facility Operators

Komplex acts as a platform connecting fans with facility operators. Facility operators are responsible for the quality and availability of their menu items, tournament management, and concession service. Komplex is not liable for facility-specific issues including food quality, tournament disputes, or facility conditions.

11. Payment Processing

All payment processing is handled by Stripe. A 10% platform fee is applied to facility transactions. By using the Service, you agree to Stripe's terms of service and privacy policy.

12. Limitation of Liability

Komplex is provided "as is" and "as available." We make no warranties, express or implied, regarding the Service. To the maximum extent permitted by law, Komplex shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid to Komplex in the 12 months preceding the claim.

13. Termination

We may suspend or terminate your account at any time for violation of these terms. Upon termination, your wallet balance will be refunded to your original payment method within 30 business days, less any outstanding fees or penalties.

14. Changes to Terms

We may update these Terms of Service at any time. We will notify you of material changes via push notification or email. Your continued use of the Service after changes constitutes acceptance of the updated terms.

15. Governing Law

These terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved in the courts of Allegheny County, Pennsylvania.
